As reported earlier today, Texas was about to execute only the 13th woman since 1976, but it appears now that the Huntsville death chamber will be vacant until April.

51 year-old Kimberly McCarthy was set to die by lethal injection at 6 P.M. this evening, and news i just now coming in that the office of the Dallas County District Attorney, will not challenge a judge's ruling.

McCarthy has been in jail for nearly 16 years convicted in one murder, and tied to two others.  According to reports, it was her viciousness of the attack which got her sent to death.

Evidence at McCarthy's trial described a woman bent on killing for crack cocaine money, and for preying on the most trusting and defenseless people - the elderly.

Earlier this month, the U.S. Supreme Court refused a case review, in addition to being turned down for a clemency request last Friday at the hands of the Texas Board of Pardons and Paroles.
