This Charge Got An Upgrade in Texas

In the past, if you were to choke a family member or "impede their breath" as stated in the law, you got a class A misdemeanor. That is the highest charge you can get, which is still a misdemeanor.

In 2023, according to dougmurphylaw.com, the state of Texas increased the penalties for assault against a member of your family. Since the passage of House Bill 1589, if the defendant has a prior conviction for this crime or for violating a protective order, assault against a family member can now be a third-degree felony.

This week, three of the 14 felons were charged with this exact crime using this recently revised law. Domestic assault is a big issue in Angelina County.
