But seriously, apparently this is an actual thing because a Texas lawyer is going viral for saying you could technically get a DUI just for being overly caffeinated.

In a now-viral TikTok, the Fort Worth-based lawyer explained that DUIs and DWIs don’t just apply to alcohol or illegal substances. Nope. Even legal substances—like caffeine—can land you in hot water if they impair your ability to drive. Emphasis on if.

Back in 2015, a California man was charged with a DUI after he was caught driving erratically—and the only thing in his system? Caffeine. No sugar, no sweetener, black coffee!

Prosecutors eventually dropped the case because they couldn’t prove how much caffeine he had in his system. But still, the charge happened. Which means it could happen again.

In other words, your third espresso shot could become your third strike! 

Moral of the story? Maybe skip the quad shot before your next road trip. Or at least don’t drive like a Fast & Furious extra after your cold brew. (Why do I feel attacked by this whole story?!)
